Task:
Part A - (30 marks)
This task consists of an essay of no more than 2,000 words using standard citation style. The purpose of the task is to give students the opportunity to demonstrate critical thinking and understanding applied to an issue related to property law and then communicate that view through the academic mechanism of an essay.
Your essay should:
Adopt a position agreeing or disagreeing with this statement.
Identify, present, discuss and analyse notions of private property, ownership and possession.
Identify, present, discuss and analyse appropriate legal materials to support your argument.
Use the conventions of essay style (e.g. structure, referencing).

Do you agree or disagree with the statement that -there are important differences between a property right and a contractual right?-
Part B - (15 Marks)
This task focuses on an analysis of a case involving property law. The task gives students the opportunity to demonstrate critical thinking and understanding applied to a practical issue in property law.
Read the case of Birch v Birch [2020] QCA 31 and answer the following questions:
What party to the dispute was Doug Birch and what interest in Fairyland did he hold in 208 and then 2011? (3 marks)
What is an inter vivos transfer and how did that impact Sylvia Birch's interest in Fairyland in 2011? (2 marks)
What was the dispute as it relates to the interests in Fairyland? (2 marks)
What was the applicant's argument with respect to the issue before the Court? (3 marks)
What was the finding of the Supreme Court? (3 marks)
What do you think about the outcome? (2 marks)
Part C - (5 marks)
