4. (25%) Describe five types of structural defects on cargo ships and explain why each of these failure mechanisms may occur.
5. (20%) Outline what is mean by “the tort of negligence” and give an example of how it may apply in:
1. Commercial shipping
2. You, as a surveyor
6. (20%) A claimant can sue for damages for both breach of contract and tort of negligence. Explain how the measure of damages applies in each case under English law.
